Elias Duke1,2,3,4

M, ID# 10298, (c 1785 - b 1840)
Father:LT Robert Duke of Richland SC & Marion MS (a 1751 - a 1820)
Charts:Joel Harper Winslett lineage
Elias Duke was born c 1785 at Fairfield Co, South Carolina. He was the son of LT Robert Duke of Richland SC & Marion MS. Elias Duke married Emily "Milly" Francis Elkins, daughter of Robert Elkins and Sarah Ann Few ?, a 1803 at Fairfield Co ?, South Carolina. Elias Duke died b 1840 at Clarke Co ?, Alabama.
Elias Duke was enumerated as Ely Duke on the 1810 Fairfield Co, SC census with he and his wife age 16-25, a son and daughter under age 10 [Abraham and Miranda] and a woman over age 44 who may be Elias' mother Sarah Abbott or Emily's mother. Other Duke families living in central South Carolina in Fairfield Co in 1810 were John age 16-25, Samuel and Aaron ages 26-44, Elizabeth over age 44, and Sarah age over 44 living next door to Elias.

Eli Dukes served as a private in the 2nd Regiment, McWillie's, South Carolina Militia during the War of 1812. This man is thought to be our ancestor because other men with a similar name were apparently not living in central South Carolina at that time.

Elias' wife Emily is believed to be from the Elkins family and Robert Elkins 1820 will refers to his daughter Milly. The final accounting of Robert's estate included receipts from Eli Dukes and payments to Elias Dukes.

By 1820 Elias and his wife, both age 26-44, were living in neighboring Kershaw Co, SC with 2 males under 10 (Darrington and Osman), 1 male 10-15 (Abraham), 1 unknown male 16-25, 2 females under 10 (Julia and possibly Martha), and 1 female age 16-25 (Miranda). Moses Dukes is also living in the county and was living nearby for the previous and following census.

Elias probably came to Alabama after 1823 because he was mentioned in the 1823 final accounting of the estate of his father-in-law, Robert Elkins in South Carolina. Thus any Duke(s) children born in AL before 1823 were not Elias' children.

On 1 Jul 1822 a petition for the sale of personal property was filed and granted for the estate of Henry Horn, deceased. Henry Horn was one of the witnesses for the will of Elias' father-in-law, Robert Elkins. The Horn estate sale buyers included Ely Dukes. The final accounting for the estate included $44.50 received from Eli Dukes and expenditures to Elias Duke. Henry Horn patented 150 acres on Foxes Creek and Broad River in Craven Co, SC in 1765; 50 acres on Fox Creek and Wateree River in Craven Co in 1768-69; and 454 acres on 25 Mile Creek in Kershaw District in 1807, the latter of which places his land closer to that of Robert Elkins, Elias' father-in-law, whose will Henry witnessed in 1820. Henry's first wife is thought to be his neighbor Celey Dukes, daughter of Nehemiah and Elizabeth Dukes, and Henry's second wife was Abigail.

This researcher wondered why Elias next moved his family to Clarke Co, AL by 1830. Orginally American Indian territory, the Indians conveyed much of western Clarke Co to the US for settlement by European Americans in 1805. The county was created by the legislature from Washington Co, Mississippi Territory in 1812. The county seat was established in the county center sometime after 1820 and named Smithville, then Macon and finally Grove Hill in 1832.

By 1830 Elias, age 40-49, was residing in Clarke Co, AL where he and his wife, age 30-39 were living with an unknown male and female under age 5, 1 son age 5-9 [Darrington], 1 daughter age 10-14 [possibly Martha], 1 son and 1 daughter [Osman and Julia] age 15-19, and 1 son age 20-29 [Abraham]. Three years later Elias' daughter Julia married in Clarke Co. Analysis of Elias' census records by James E. Dukes show seven unknown children: sons born about 1806 and 1827, daughters born about 1813, 1817 and 1823, and possible daughters Martha Ann and Mary born in 1821 and 1825 respecitively. Clarke Co, AL probate records for John F. Smith show a William P. Dukes, who was illiterate, administering the Smith estate between 1846 -1848 (Clarke Co, AL Estate Case Files, 1810-1915, https://www.familysearch.org/search/film/008194559?cat=989192, p. 383-397). One of Elias' daughters is believed to have married into a Smith family, thus there is a possibility this William P. Dukes was one of the two missing sons of Elias.

A contemporary with Elias was Hardeman Duke (many different spellings of both of his names) enumerated as Hardyman Dake age 50-59 with 11 total in his household in 1830 in adjacent Monroe Co, AL, across the county line from Elias. Hardeman resided in Clarke Co when Elias moved to Alabama and no evidence has been found that the two men were related. Although online family trees claim some of the same children for both Elias (https://www.wikitree.com/wiki/Dukes-11) and Hardeman (https://www.wikitree.com/wiki/Duke-64), a 2017-2021 atDNA study of descendants of the two men and historical documents held by Hardeman descendants were used to parse the appropriate children to each man. Another key differentiating factor between Elias' and Hardeman's children present in Clarke and Monroe counties AL in 1830 was the Duke(s) children born between 1820 and 1829 in Alabama belong to Hardeman and the children born between 1820 and 1829 in South Carolina belong to Elias, although both families were in continguous Alabama counties by 1830.

On 19 Oct 1831 Elias Dukes deeded to John Darrington, both of Clarke Co, AL, 158 acres in the southeast quarter of section 19 in township 6 range 4 east for $250. The deed was witnessed by Elvia[?] and Scarborough Gayle and recorded 6 Nov 1831. Elias and John Darrington were good friends.

Elias' exact death date and place is not yet known. Elias did not appear on the 1840 census with his wife and family.

Every possible phonetic spelling and shortening of Elias' name occurred in the records. Of note, Lee is also a nick name for Elias but he was not found using that name.

Although there is no record evidence Elias was the son of Robert of Richland, Elias was not the son of the two other Roberts living in South Carolina -- Robert Duke of Fairfield Co, SC (~1740 - ~1784) and Robert Duke of Dry Creek, Lancaster Co, SC (~1730 - ~1784). At one time Elias was believed to be the son of Robert Duke of Fairfield (aka Robert Duke of Camden) but Elias was not named on Robert's will.

Elias' ancestors and descendants are included in the Duke (Dukes, Duc, LeDuc, DuGue, etc) Genealogical yDNA Project as part of Group 5. Group 5 includes several Duke families that emigrated from the South Carolina Midlands (Fairfield, Kershaw, Richland and Lexington counties) to Alabama and Mississippi. Group 5 also includes the family of John Duke of Lancaster Co, SC whose sons John and Moses Duke went on to Barnwell Co, SC, John later immigrating to Tatnall Co, GA. This group falls within haplogroup R1b. (http://genealogy.ztlcox.com/index.html)

The evidence Elias was the son of Robert Dukes of Richland, MS is a Y-111 yDNA marker test for James Eulyce Dukes which puts James in the group 5 of the FTDNA yDNA Dukes Study. A yDNA Y-111 test results comparison between fourth cousins once removed Charles Duke and James Eulyce Dukes showed their respective ancestors William Simeon Duke and Elias Dukes https://www.wikitree.com/wiki/Dukes-11 were brothers and sons of Robert Duke of Richland, SC and Marion MS https://www.wikitree.com/wiki/Dukes-705. This DNA evidence is supported by three other yDNA matches and four atDNA triangulation matches identified during the 2017 - 2121 atDNA Dukes DNA study. Theses DNA verifications extend through Elias' great grandfather Jeremiah Duke as the common ancestor and are included on wikitree.com https://www.wikitree.com/wiki/Dukes-547.

Emily "Milly" Francis Elkins1,2,3,4,5,6

F, ID# 10299, (c 1786 - a 1860)
Father:Robert Elkins (a 1740 - 1820)
Mother:Sarah Ann Few ? (a 1745 - b 1819)
Charts:Joel Harper Winslett lineage
Emily "Milly" Francis Elkins was born c 1786 at Fairfield or Kershaw Co, South Carolina. She was the daughter of Robert Elkins and Sarah Ann Few ? Emily "Milly" Francis Elkins married Elias Duke, son of LT Robert Duke of Richland SC & Marion MS, a 1803 at Fairfield Co ?, South Carolina. Emily "Milly" Francis Elkins died a 1860.
Emily Elkins was listed as Emily Dukes in the 1840 Clarke Co, AL census with 1 female 10-14 (born 1826-1830) and 1 male 15-19 (born 1821-1825.) Also in the household was a female age 20-29 (born 1811 -1820) who was possibly an older daughter and is likely the mother of 1 male and 2 females under age 5 (born 1836 - 1840) because Emily, who was born about 1786, most likely ended her childbearing about 1828.

Emily's nearest neighbors in 1840 were W. M. Williamson age 20-49, S. Brashkins, Hance Stokes, Wm M. Wilson, Joshua Wilson, W. T. James, Jas. M. Wilson -- five out of seven households having young children at home. Some of the other families with young children could include Emily's daughters, such as Meranda who was born in South Carolina who has not been found in other records since she was mentioned in her grandfather's will. Emily's son Osman married Sarah Wilson in 1833, possibly from one of these Wilson families.

Living next door to Emily in 1840 was Hance Stokes who was born about 1802 in North Carolina. Hance's first marriage was to Margaret McDaniel in 1820 in North Carolina; thus Margaret would have been around age 36 to 40 in 1840, but Hance was living alone with six children: a female age 15-19, a female age 10-14, 2 males age 5-9 and 1 male under age 5. The census was certified on 2 Nov 1840.

On 9 Nov 1840 in Clarke Co, AL Hance married for the second time to Maranda J., whose last name is unknown as no marriage certificate was filed. Maranda was born about 1816 in South Carolina, which is where Emily lived in 1816.

By 1850 Hance was a miller with 400 acres. Hance and Maranda named their children Eliza, Susan D., Thomas Charles, Frances, Ariminta N. (born about 1853), Edward E., Jesse V. and William Davis Stokes. One of Emily's given names is believed to be Frances, and Emily's granddaughter born about 1847 to Darrington Dukes was named Arimintha and her great-granddaughter Ariminta Jane Talton was born in 1865. Emily's husband was named Elias but a record was not found showing the full name of Hance Stoke's son Edward E. By 1860 Hance was a shoemaker and his wife was using the name Mary J. Stokes. Alternatively, Emily and Maranda might not have been related at all.

By 1850 Emily is believed to be the Francis Duke age 63 born about 1787 in South Carolina who is living in the home of her daughter Martha Ann and Joshua Hudson in Franklin Co, AL.

Unsourced family trees list Joseph Talton as the father of Joel Talton, but there is no proof that this is correct. In Anson and neighboring Union Co, NC the oldest census records were for William C. Talton born circa 1802, R. W. Talton, and Pleasant Talton born circa 1805. No records were found for a Joseph Talton. In Liberty, Marion District, South Carolina in 1800 there was a Joseah Tarlton over age 45 on the census with 3 females in the household. In 1810 a Joseph Tarleton, over age 45, in Salem, Sumter Co, SC with a total of five relatively young members in the household.

Meanwhile in between 1816 and 1821 the Monroe Co, Mississippi Territory Orphan's Court was processing actions for the estate of a Joel Tarlton with his will/court location noted as Mobile Co, Mississippi Territory.

John C. Smith was born c 1809 at South Carolina. He married Anna "Anny" (Unknown) c 1832. John C. Smith died a 1870 at Tallapoosa Co, Alabama.
John Smith I was farming in 1850 in Tallapoosa Co, AL where he lived with his family totaling seven people. By 1860 his address was New Site, Tallapoosa Co, AL where he worked as a mechanic. The value of his real estate was $800 and his personal estate was valued as $400.

The 1866 Tallapoosa Co, AL census shows John C. Smith age 50-60 living alone, which is strange because his wife was alive and he had young children, so this is possibly a census taker's error or his family was away; living 2 doors away is a ____ C. Smith (does not look like his son Henry's name but Henry is the right age) with his wife, both age 20-30, with 3 small children. By 1870 John was still residing in Tallapoosa Co and was farming. Although his wife was, John and his namesake son were not able to read or write.

John's middle name is believed to be Calhoun. John and Anna are NOT the John Smith and Anny Smith married in Rowan Co, NC in 1818 -- before our Anna was born.
